TERMS OF USE

These terms and conditions as listed under will be used for regulating the policies that may be used in governing the services that are provided by us and availed by you. This User Agreement shall be considered as an “electronic record” as read and construed under Information Technology, Act 2000 of India and any amendment thereof or as construed under equivalent local law of your jurisdiction and rules there under as applicable. This User Agreement is generated by a computer system and does not require any physical or digital signatures.

The following terms wherever it appears on the website or the app shall have the same meaning as provided under unless otherwise explicitly stated.

The terms ‘We’, ‘us’, ‘company’ and the like shall mean Tik Tube.

The terms ‘You’, your’ shall mean the person accessing/using/visiting the website.

The terms user means the person who is using the website and/or watching the content.

The terms content creators shall mean any person who has a channel and/or uploads videos.

Types of videos

A user can watch three kinds of videos here, which are as follows:

Free: You can watch free content only by following the channels. To watch the free videos you don’t have to pay anything.

Premium: Users have to pay a monthly subscription fee to watch premium videos. The subscription charge may vary from channel to channel.

Paid: To watch paid videos users have to pay a certain amount for that particular video. You have to watch these videos for which you make a payment within the 24 hours of payment otherwise you have to pay again to watch these videos.

Monthly subscription process

There will be no option for the automated subscription of the channel after the expiration of previous subscription plan. The users have to pay the subscription charge again after the expiry of their previous subscription plan. This is because of the subscription charge of a channel may increase or decrease after a time span.

No downloading facility

A user cannot download a video of any section whether it is on free, premium or paid for watching it later. For free videos you can watch it at any time on the app and for premium videos u can watch all the videos on premium section after subscribe the channel for one month on the app you cannot download those videos for later use and for paid videos user have to pay a certain amount to watch this video after make the payment user have only 24hr to watch such videos.

User’s usage of coins

There shall be no direct monetary transactions between TikTube and its users. All transaction shall be in the form of virtual coins.

The transfer of money shall take place with the help of a payment gateway.

The user shall purchase the coins and it shall be stored in the wallet of the user.

The user shall be able to view content by using the requisite number of coins.

The value of the coins and its purchase procedure shall be decided by us and it liable to change from time to time.

The user in order to view any video will have to use the coin (the number of which shall be mentioned…)

The coins are non transferrable in nature which means only the purchaser of the coins have the right to use the same and cannot transfer them to others.

The users do not have the right to withdraw the coins. Once the coins are purchased no refund of the same will be made under any circumstances.

Notice Board Management

TikTube reserve the right to change or alter or update the app at any time. To notify our every user we generated a notice board management system by which we inform every user about the every updates and news of the app and we also inform you about the upcoming features of the app. It is your duty to make yourself updated from time to time about the app. If you are not check the notice board everyday you may miss something important and that may cause any kind of damages or technical issues in your app and for this damages or loses TikTube will not be liable. And you have to agree with our al updates otherwise you are able to access our service further.

Restrictions on comments

No user have the right to use any abusive language in the comment section on any video this may cause any kind of loss of that channel. If any user doing any such activities then we will take a legal action against the user and blocked the account of the user..

Privacy of account

We provide for single screen accounts. You will not be able to access your account from two different devices and you will be automatically logged out from the other device. We would advice you not to share your id and password with unknown persons and use it only for your own personal use. If in case you made a mistake from your side and suffer any kind of losses or damages by doing above mention activities like, sharing your password, OTP and ID to other persons then you are the liable for this circumstances and TikTube we not be liable for your loss or damages.

Do not use the account for any commercial purposes. The users do not have any right to screen record or download the video and/or use it for any purpose other than viewing the same. If anyone is found to be doing any of the above action a strict legal action may be taken against that user.

Safety, Security and Integrity.

We work to protect the safety, security and integrity of our services. This includes properly dealing with abusive and anti social people and also deal with the activity which violating our terms. We also take necessary steps to stop misuse of our service including harmed conduct towards other, violation of our terms and policies and address situations where we may be able to help support or protect our content community. If we Learn of people or a activity like this, we will take appropriate action, including by removing such people or activity or contracting law enforcement. Any such removal will be in accordance with the Section "removal of videos" below.

Availing of our services

In order to avail some of our service you may be required pay a fee or perform some other action like following or subscribing the channel.

User liability

User agrees that neither TIKTUBE its directors, entities associated including employees, contractual third parties shall be liable for any direct or/and indirect or/and incidental or/and special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the services or resulting from any information or/and services purchased or/and obtained or/and messages received or/and transactions entered into through or/and from the service or/and resulting from unauthorized access to or/and alteration of user's transmissions or/and data or/and arising from any other matter relating to the service, including but not limited to, damages for loss of profits or/and use or/and data or other intangible, even if TIKTUBE has been advised of the possibility of such damages.

User further agrees that TIKTUBE shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent. We shall not be liable to provide any service due to any situation which is beyond our control or any force majeure conditions like change in the government policies, rules or regulations, natural calamities, riot, strike, epidemic, Act of God etc.

User agrees that Company shall not be responsible or liable to user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall TIKTUBE’ total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to TIKTUBE, if any, that is related to the cause of action.

Removal of videos

The videos may be removed in two ways

1. If there is a complaint against any video by any user, we will investigate the same and if found violative of any policy the video will be removed. If there are three or more complaints against any channel the channel may be terminated permanently and all the videos of the channel will be removed.

2. The videos may be removed by the content creators under their sole discretion.

In case of any of the above situation we will not be responsible for any payment paid for any video. The user will not have the right to make us liable for the same. Hence the users are requested to apply discretion for any action they take on our app or website.

Reporting:

- If any user during use our Site/or APP found any video or channel doing something wrong or illegal content they can report that channel or video at any time.

- The person who lodged a report must mention the reason here with.

- After receiving a report our legal team will verify the validity of the report and take action accordingly.

- The information of the person who lodged a report will not be disclosed by our side.

-We are not bound to reply to every report if your report is valid and meaningful. We will take legal action against the channel owner or the content creator

- if any content creator or a channel owner lodge a report against the any user that the user repeatedly use abusive language on their videos then the account of that user can be blocked and we have the right to take legal action against that user.

- If any content creator or a channel owner reports any user’s account, then we will serve information about them to both, to solve their disputes/problems by own.

Registration

The users shall be required to register by using their Mail ID for the first time they access our services. They will also be required to enter a password and henceforth they will be required to login with the same user ID and password. In case you forget your password, you have to follow the steps for forget password and enter the OTP given in your email. All our information is encrypted. Cookie’s policy

We use cookies for the purposes storing information which is not personal in nature to serve you better. Cookies are the unique identifiers which are used to transform the information you provide into our servers to store it for future use and to prevent the hassle of entering the information again and again. The information that we store in your cookies are name address, username mail id, language preference, date of birth, account preferences etc. We do not store any personal information like password or Pin.

At present we use only compulsory cookies but later on we may introduce preferential cookies and you will get an option to choose.

Payment gateway

In order to facilitate proper payment for some services, we take the help of third-party payment gateway. We do not accept any direct payment. You are requested to read not only our terms of use but also the terms of use and privacy policy of our payment gateway. You may be redirected to another page while you are trying to make payment. During the entire process if you close the tab or page your payment will fail. Payments can also fail if there is any connectivity issue. In such a scenario if your payment fails and your services are not active please contact with the payment gateway team and your money shall be refunded. We shall not be responsible for any such dispute.

We shall not be responsible for all or any dispute or difference relating to online payment made by You through credit card or debit card or net banking account or cash card or via any other mode available. will not be responsible for any financial loss, inconvenience or mental agony resulting from misuse of Your credit card or debit card or net banking account number or cash card and other details. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details. In case you are having problems in making payment please do tell us.

Governing laws

In case of any dispute between you and TikTube the laws of India will be used to govern the method of dispute resolution. The legal authorities of TikTube shall have the right to decide the competent court for the purposes of dispute resolution.

Severability of the terms

If any provision of these Terms shall be held unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. The failure of Tik Tube to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Site(s)/ App(s) or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred. This provision shall remain in full force and effect notwithstanding any termination of your use of the Site(s)/ App(s).

Hyper links to other websites

Our app might contain links of other websites and apps. We do not own the website or app if you want to access those apps the liability will be on you. We would recommend you to read through their terms of service and privacy policy for the better knowledge about the app otherwise you may suffer from any kind of losses and for which you cannot make allegation on us.

Changes to our app

You can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes. We shall also not be liable to inform our users in the event there is a transfer of ownership.

Waiver of rights

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Content complaint policy

The users will have the right to report any content from the options given below on every content. We will review the complaint and if found appropriate we will remove the content. The users are requested not to make any false complaint as legal actions may be taken against the users for the same.

Suspension and termination

TikTube reserve the right to suspend or terminated your account at any time if TikTube will receive any reports against you by a channel owner. TikTube may also have the right to block your account permanently if you break any of our terms and policies. Once your account blocked for permanently you would not able to use TikTube in future.

KINDLY NOTE: IF YOU STILL PROCEED TO ACCESS THE APP(S) AND SHARE THE PERSONAL INFORMATION WITH TIKTUBE, YOU SOLELY SHALL BE RESPONSIBLE FOR ANY KIND OF LEGAL OR OTHER ACTIONS THAT SHALL TAKE PLACE AND TIKTUBE SHALL NOT BE RESPONSIBLE FOR ANY ACTIONS IN ANY MANNER WHATSOEVER.
